It may seem that the only person entitled to the property of a deceased individual (the “decedent”) is either the spouse or maybe the decedent’s children, a will or Oklahoma statute may say otherwise.

An individual has the power and right to determine, with some minor limitations, who can and can’t have their property when they pass away.  This is primarily done by a Last Will and Testament but can also take place through a Trust.  Further, those entitled under Oklahoma statute to inherit, known as legal heirs, can be disinherited.  These are all factors that play a part in the probate or administration of the estate of a deceased person.  The primary purpose of the probate or estate administration is to make sure that the individuals entitled to receive property or money, actually receive it and there are a lot of rules that go into making sure it happens in accordance with law.
