Whether you are purchasing new real estate, transferring real estate to a friend or family member, or refinancing a loan with your lender or bank, a title examination and opinion is often a necessary step and is always recommended.  Whenever title to a home, business, or raw land changes hands, the purchaser, and the lender if one is involved, wants to know that the current owner has good title to the property.  Good, marketable title can be impacted by a number of things including, but not necessarily limited to, mortgages to other lenders, liens by contractors or municipalities, judgments from civil or criminal cases, bankruptcy orders, and the list goes on. 

In theory, the purchaser who received a Warranty Deed could pursue the seller in a civil action if the property was encumbered by any of the aforementioned issues, but in reality, a civil action may not do any good if the seller of the property has left the state or already spent the proceeds.  The best-case scenario is often that the seller already purchased a new property and a complicated legal action must be instituted to resolve the matter.

Instead of ending up in a situation like this, most attorneys and lenders will recommend that a buyer have an abstract built or updated by an Oklahoma abstract company in order that a title attorney may examine the records provided in the abstract to determine what, if any, requirements must be satisfied in order to provide good marketable title to the buyer or allow the lender to be secured in their financing of the purchase of such real estate.
